Rewards Service-Specific Terms

These Rewards Service-Specific Terms apply to the Rewards Services, as defined below, and are subject to and governed by the terms and conditions of the General Terms which are incorporated herein by reference (collectively, these Rewards/Rewards Service-Specific Terms and the General Terms are the “Rewards Terms”).  Capitalized terms used in these Service-Specific Terms have the meanings provided in the General Terms unless otherwise defined herein.

Please carefully read the Rewards Terms before accessing or using the Rewards Services.  The Rewards Terms may contain links to additional governing terms and conditions that are incorporated by reference and will apply depending on your use of the Rewards Services.  By accessing or using the Rewards Services, or otherwise demonstrating your acceptance of the Rewards Terms, you accept and are bound by the Rewards Terms.  If you do not agree to be bound by the Rewards Terms, then you may not access or use the Rewards Services.

PLEASE BE ADVISED THAT THE REWARDS TERMS ARE SUBJECT TO THE DISPUTE RESOLUTION AGREEMENT (SEE SCHEDULE A AT THE END OF THE GENERAL TERMS, TITLED “DISPUTE RESOLUTION TERMS (ARBITRATION AGREEMENT; CLASS AND COLLECTIVE ACTION WAIVER; AND JURY TRIAL WAIVER)”), THAT GOVERNS HOW CLAIMS YOU AND REALPAGE HAVE AGAINST EACH OTHER ARE RESOLVED, WHICH WILL, WITH LIMITED EXCEPTION, REQUIRE THE PARTIES TO SUBMIT CLAIMS THEY MAY HAVE AGAINST ONE ANOTHER TO BINDING AND FINAL ARBITRATION. UNDER THE DISPUTE RESOLUTION AGREEMENT, THE PARTIES WILL (I) ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST EACH OTHER ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, AND (II) BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY ON AN INDIVIDUAL BASIS.

1. DESCRIPTION

The Rewards Services consist of RealPage Rewards (as described in more detail herein, the “Rewards Program”), a Rewards program offered by RealPage.  Your access to and use of the Rewards Program is subject to (i) the Rewards Terms and (ii) any other terms and conditions specific to the Rewards Program that are described elsewhere on any RealPage website or mobile app (the “Rewards Program Rules”).

Please read the Rewards Terms carefully before enrolling in, accessing, or otherwise using the Rewards Program.  By enrolling in, accessing, or otherwise using the Rewards Program you expressly acknowledge and agree to the Rewards Terms and the Rewards Program Rules, and you acknowledge that you have read the RealPage Rewards privacy policy, which may be viewed at https://www.realpage.com/legal/rewards-privacy-policy/.  Without limiting anything set forth below, if you breach the Rewards Terms, or the Rewards Program Rules, then RealPage may, in its sole discretion, void or confiscate any Points (as defined below) or Rewards (as defined below) previously earned by you and/or terminate your Rewards Program membership.

RealPage offers the Rewards Program at its sole discretion.  RealPage hereby reserves the right to offer you alternative or additional Rewards Program benefits based on your Community (defined below) of residence, to terminate or modify the Rewards Program and/or any portion thereof, and to modify Rewards Terms and/or the Rewards Program Rules at any time without notice to you, even if any such termination or modification affects the value of any Points or Rewards previously earned by you.  The date provided at the top of this page indicates the most recent update to these Service-Specific Terms.  We recommend that you review the Rewards Terms and the Rewards Program Rules periodically for any changes.  The Rewards Terms and the Rewards Program Rules are subject to interpretation by RealPage.

2. REALPAGE PARTY

The RealPage Party that provides the Rewards Services is RealPage, Inc.

3. PRIVACY POLICY

The RealPage Rewards privacy policy, which may be viewed at https://www.realpage.com/legal/rewards-privacy-policy/, describes how RealPage and its subsidiaries collect, use, and disclose certain personal data in connection with the Rewards Program. Your state of residence may require us to make additional disclosures to you; these disclosures, including disclosures to Colorado residents regarding a Bona Fide Rewards Program, are included in the Rewards privacy policy linked above.

4. ELIGIBILITY

To participate in the Rewards Program, you must:

  1. Be at least 18 years of age;
  2. Be a resident leaseholder at a residential complex whose owner or operator, as applicable, (i) has subscribed to one or more of RealPage’s services and (ii) offers RealPage’s Loft/ActiveBuilding Services (a “Community”); and
  3. Enroll in the Rewards Program through such signup and/or opt-in procedure(s) as RealPage may require from time to time.

5. POINTS

Rewards Program members in good standing (“Members”) may, from time to time, have the opportunity to earn Rewards Program points (“Points”), as described in the Rewards Program Rules.  Points earned by a Member are only for that Member’s personal use and cannot be sold, bartered or transferred to, or otherwise used by, any other person.  Members do not have any legal right to any Points in their accounts unless and until such Points are redeemed for Rewards (as defined below).  Until the time of such redemption, Points may be forfeited upon occurrence of any of the following events:

  1. Member’s breach of the Rewards Terms, the Rewards Program Rules, or any other agreement in connection with the Rewards Program;
  2. Member ceasing to be a resident of a Community for at least 30 days;
  3. Member inactivity (defined as failing to perform any activity within the Rewards Program) for at least 12 months after receipt of the Points at issue;
  4. Member terminating its relationship with the Rewards Program;
  5. The Member’s Community terminating its relationship with RealPage;
  6. RealPage terminating its relationship with the Member’s Community, or with the Member; or
  7. RealPage discontinuing the Rewards Program and/or the Points portion of the Rewards Program, at its sole discretion.

6. REWARDS

RealPage partners with various third-party vendors (each, a “Rewards Partner”) to offer Members certain products, services, discounts and/or other benefits of Rewards Program membership, including products, services, discounts and/or other benefits for which Members may redeem Points, in each case as described in the Rewards Program Rules from time to time (collectively, “Rewards”).  In addition to the Rewards Terms and the applicable Rewards Program Rules, Rewards may be subject to additional terms, conditions and/or other policies of the applicable Rewards Partner.  Please read all applicable Rewards Partner terms, conditions and other policies carefully prior to ordering a Reward.  All Rewards order processing and fulfillment is provided through our Rewards Partners.  RealPage is not responsible for, and will have no liability arising out of, any Rewards offered, provided or fulfilled by Rewards Partners.  While we attempt to provide accurate descriptions of Rewards, we do not warrant, however, that the descriptions are accurate, complete, reliable, current or error-free.  If a Reward is not as described, the Member’s sole remedy is to return the item to the applicable Rewards Partners, as specified in the applicable Rewards Partner’s return terms.  Additionally, we strive to provide accurate pricing and inventory information regarding the Rewards.  We cannot, however, insure against Reward pricing and inventory errors.  Your receipt of an order number or an email order confirmation does not constitute the acceptance of a Reward order or a confirmation of an offer to sell any Reward by RealPage.  We reserve the right to correct any error, inaccuracy, or omission in any order (including after an order has been submitted).  If an error occurs or we need to correct an order, we will notify you by email.

7. REWARD CARDS

In some instances, Rewards may consist of gift cards from one or more Rewards Partners (“Reward Cards”).  Without limiting anything else in the Rewards Terms, or the applicable Rewards Program Rules, by redeeming Points for a Reward Card, you expressly acknowledge and agree to the following additional terms and conditions and fees listed below:

  1. After redeeming Points for a Reward Card, you will receive an email with instruction on how to claim your Reward Card.  You must claim your Reward Card within 60 days after receipt of that email.  If you fail to claim your Reward Card during that 60-day period, you forfeit your right to the Reward Card.
  2. Use of Reward Cards is subject to the limitations, restrictions, terms, conditions and/or other policies imposed by their respective issuer
  3. Certain Reward Cards may be subject to applicable processing fees, including but not limited to shipping and handling fees.  Such fees may be subtracted from the available funds on the card.
  4. RealPage is not and shall not be responsible for Reward Card(s) that are lost or stolen and will not reissue Reward Card(s) that are lost or stolen.

8. REWARDS PROGRAM MEMBERSHIP TIERS

The Rewards Program includes three membership tiers: Silver, Gold and Platinum.  Upon enrolling in the Rewards Program, you will be granted Silver tier membership.  Silver tier Members will have the opportunity to earn Gold tier membership, and Gold tier Members will have the opportunity to earn Platinum tier membership, by performing certain qualifying activities as set forth in the Rewards Program Rules.  RealPage, in its sole discretion, reserves the right to offer different Points opportunities and/or different Rewards opportunities to Silver tier, Gold tier and Platinum tier Members, respectively, from time to time, as set forth in the Rewards Program Rules.  Rewards Program membership, and/or any membership tier status within the Rewards Program, may be forfeited upon occurrence of any of the following events:

  1. Member’s breach of the Rewards Terms, the Rewards Program Rules, or any other agreement in connection with the Rewards Program;
  2. Member ceasing to be a resident of a Community for 30 days or more;
  3. Member relocating to a different Community outside the portfolio of Member’s then current Community owner or operator;
  4. Member inactivity (defined as failing to perform any activity within Rewards Program) for at least 12 months after receipt of the Points at issue;
  5. Member terminating its relationship with RealPage, or with the Rewards Program;
  6. The Member’s Community terminating its relationship with RealPage;
  7. RealPage terminating its relationship with the Member’s Community, or with the Member; o
  8. RealPage discontinuing the Rewards Program and/or any applicable membership tier within the Rewards Program, at its sole discretion.

9. GEOGRAPHIC RESTRICTIONS

The Rewards Program is based in the state of Texas in the United States and provided for access and use only by persons located in the United States.  You acknowledge that you may not be able to access or use all or some of the Rewards Program in certain areas within and outside of the United States and that access thereto or use thereof may not be legal by certain persons or in certain countries.  If you access or use the Rewards Program from outside the United States, you are responsible for compliance with local laws.

10. YOUR COMMENTS AND CONCERNS 

All feedback, comments, requests for technical support, and other communications relating to the Rewards Program should be directed to support@activebuilding.com.

11. SMS TEXT ALERTS AND OTHER REWARDS SERVICES-RELATED NOTIFICATIONS

You understand and agree that by providing us with your mobile phone number you consent to being contacted at that number by a person, and via prerecorded voice messages and automatic telephone dial devices relating to the Rewards Services.  You also consent to receiving Rewards Services-related emails to any email address that you provide.  We may offer you the ability to enroll your mobile phone number in our Short Messaging Service text message service (the "SMS Service") for purposes of receiving messages from RealPage regarding information, resources, and marketing materials related to the Rewards Services in the form of: operational alerts and reminders from your property management company, marketing communications and information for Services available for your residence and Community, and digital tools and other communication materials.

  1. Enrollment and Consent.  If SMS Service is made available to you through the Rewards Services, by providing your mobile phone number(s) and opting in to the SMS Service:
    1. You authorize RealPage and your property management staff to send text messages to the mobile phone number(s) included in your Rewards Services profile.
    2. You acknowledge and agree that your completion of the online registration process constitutes your written, express consent to enroll your mobile phone number(s) in the SMS Service.
    3. You confirm that you are the owner or subscriber of the mobile phone number(s) and authorized to enroll them in the SMS Service. You acknowledge the number of non-solicited text messages received from the SMS Service may vary.

      Prior to completing your enrollment in the SMS Service, we will send a confirmation text message to your designated mobile phone number(s). To complete enrollment, you must confirm receipt of the text message from your mobile device by following the instructions in that text message.
  2. Opting Out.  You may cancel your enrollment in the SMS Service at any time by:
    1. Removing your mobile phone number(s) from the SMS Service registration; or
    2. Texting "STOP" in reply to any text message received from the SMS Service
  3. SMS Service Availability and Other Information.  The SMS Service relies upon third party wireless service provider networks to deliver text messages. RealPage is not liable for the availability (or lack thereof) of wireless network coverage or the failure of the wireless networks to deliver a text message. RealPage disclaims any responsibility for any wireless service used to access the SMS alerts. RealPage SMS alerts are available to users based in the United States. You understand and acknowledge that SMS alerts are not intended to be accessed from outside of the United States. Wireless carriers are not liable for delayed or undelivered messages. Message and data rates may apply.
